Membership and Program Waiver I, being 18 years of age or older, do for myself (and for or on behalf of my child participant, if said child is not of age or older) do hereby release, forever discharge and agree to hold harmless BBT Hockey (LECOM Sports Park), Erie Sports Now Fitness & Performance Center, Lake Erie Sports Alliance (LESA) Directors and volunteers or any other owners, subcontracted trainers, or employees of BBT Hockey and Erie Sports Now Fitness & Performance Center & while participating in supervised, or independent hockey, skating, or fitness training at LECOM Sports Park, Erie Sports Now Fitness & Performance Center and all liability, claims or demands for personal injury, sickness or death, as well as property damages and expenses, of any nature whatsoever which may be incurred by the undersigned and/or the child participant that occur while said participant is participating in the above described activities. I (and/or the child participant) am aware that coaches and performance staff are not licensed physical therapists or trained medical personnel and am participating in programs voluntarily at my own risk and for recreational purposes only. I acknowledge that hockey, skating and fitness training may be strenuous and that a physician’s examination and approval should be obtained prior to beginning any fitness program. I accept all responsibility for my (and/or the child participant’s) health and any resultant injury that may occur during any LECOM Sports Park, Erie Sports Now Fitness & Performance Center training session and agree to hold harmless and indemnify BBT Hockey, Erie Sports Now Fitness & Performance Center, including owners, and any other employee or sub-contracted performance coach. I understand that BBT Hockey, Erie Sports Now Fitness & Performance Center, are not responsible for supervision outside of set coaching or training times. I (and/or the child participant) also give BBT Hockey, Erie Sports Now Fitness & Performance Center permission to take and post pictures and videos of me (and/or the child participant) participating in fitness activities for social media and marketing purposes only. Return/Refund Policy: Members and participants may cancel their agreement without penalty within three business days after initial agreement signing with a full refund. All cancellations after this period will require in person, advance written notice of intent to cancel 30-days prior to next billing due date. Missed sessions: Participants can miss up to 2 sessions and must make them up before the end of their current program or within 2 sessions of the next month. Attendance: Your non-use of the training program or membership that you selected will not relieve you of your obligation to make payments as outlined herein, and it does not grant you a refund. Cancellations Policy: Memberships or program enrollment must be cancelled 30-days prior to the next billing due date. If written notice to cancel is not received 30-days prior to the next billing date, you will be charged for the next scheduled payment. Appointment Cancellation: A 24-hour notice of cancellation is requested for personal training clients. After one violation, a full session will be deducted from remaining package sessions. Purchase Policy: Once you provide your account information and authorization we'll automatically debit the predefined accounts for the appropriate dues as designated for any programs, classes or membership agreement. The LECOM Sports Park, Erie Sports Now Fitness & Performance Center reserves the right to refuse entry to any member or program participant whose account has not been settled. Any questions regarding membership or program accounts may be directed to Erie Sports Now Fitness & Performance Center staff. Term & Conditions: All members and program participants shall comply with rules and any and all LECOM Sports Park, Erie Sports Now Fitness and Performance Center terms and conditions. The rules contained herein are not inclusive. Amendments to LECOM Sports Park and Erie Sports Now Fitness and Performance Center Terms and Conditions and Rules and Regulation may be made from time to time as necessary. Enrollment is valid for the class time allocated only. Participants must abide by the club rules and direction of the Coach at all times. Failure to comply with the Coach directions will result in non-refundable cancellation. Monthly dues shall continue regardless of use.
